Welcome to PAPER YARROW. By placing an order through our website, you agree to be bound by these Terms of Service. Please read them carefully before making a purchase.

1. Acceptance of Terms

By accessing and using the PAPER YARROW website and placing an order, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services or place orders.

2. Services Offered

PAPER YARROW offers the sale and delivery of:

• Flowers: Fresh floral arrangements, bouquets, and single stems
• Fable & Foundry: Curated antique and vintage items
• Events: Event floral design and coordination services

Orders may be placed for delivery (within our service area) or pickup at a designated location in the East Village, Manhattan.

3. Purchase Agreement

When you place an order through our website, you are making an offer to purchase the selected items. Your order represents a binding contract once payment is successfully processed and you receive an order confirmation email.

Order Confirmation: You will receive an email confirmation once your payment has been processed. This email serves as acceptance of your order and forms a contract between you and PAPER YARROW.

We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

4. Pricing and Payment

Prices: All prices are displayed in U.S. Dollars (USD) and are subject to change without notice. The price charged will be the price displayed at the time you complete your order.

Payment: We accept payment via credit card, debit card, and other methods supported by Stripe, our secure payment processor. Payment is due at the time of order placement.

Delivery Fees: Delivery charges are calculated based on distance from our location in the East Village. Delivery fees are displayed during checkout before you complete your purchase.

All sales are final once payment is processed, unless the order is cancelled by PAPER YARROW.

5. Product Availability

Limited Stock Items: Certain products, particularly vintage items, are one-of-a-kind or available in limited quantities. While we make every effort to update inventory in real-time, items may sell out before your order is processed.

Made-to-Order Items: Some products, such as custom floral arrangements, are made to order. These items will be prepared fresh for your selected delivery or pickup date.

If an item in your order is unavailable, we will contact you promptly to offer a substitution or full refund for that item.

6. Delivery and Pickup

Delivery Service

• Service Area: We deliver within a 10-mile radius of the East Village, Manhattan. Orders placed outside this area may be subject to additional fees or may not be eligible for delivery.
• Delivery Dates: You select your preferred delivery date during checkout. We will make every effort to deliver on the requested date during our standard delivery window.
• Address Accuracy: You are responsible for providing an accurate and complete delivery address. We are not responsible for orders delivered to incorrect addresses due to customer error.
• Delivery Issues: If no one is available to receive the delivery, our driver may leave the package in a safe location or return it to our shop. Perishable items (flowers) left unattended are subject to spoilage, and we cannot provide refunds or replacements.

Pickup Service

• Pickup Location: Pickup orders are available at Tompkins Square Park, East Village, Manhattan, or other designated locations as specified during checkout.
• Pickup Dates: You select your preferred pickup date during checkout. Please arrive during the designated time window provided in your confirmation email.
• Identification: Please bring your order confirmation email or order number when picking up your order.
• Delivery Tracking: For shipping orders, you will receive a tracking link via email to monitor your delivery status in real-time.

Note: Deliveries are fulfilled by Uber Direct. We are not responsible for delays caused by delivery services, traffic, weather conditions, or other circumstances beyond our reasonable control.

7. Perishable Goods

Fresh Flowers: Fresh flowers are perishable goods with a limited shelf life. By placing an order for perishable items, you acknowledge and accept the following:

• Fresh flowers typically last 5-7 days with proper care
• You are responsible for proper storage and care upon receipt
• We are not liable for spoilage after delivery or pickup

8. Cancellations and Refunds

Cancellations by PAPER YARROW

If we are unable to fulfill your order due to product unavailability, operational issues, or other unforeseen circumstances, we will cancel your order and provide a full refund to your original payment method. You will be notified via email with the reason for cancellation.

Customer-Initiated Cancellations

If you wish to cancel your order, please contact us as soon as possible at the email or phone number provided in your confirmation email. Cancellation requests are handled on a case-by-case basis:

• Before Order Preparation: If your order has not yet been prepared, we may be able to cancel and issue a full refund
• After Order Preparation: If your order has already been prepared or is out for delivery, we may not be able to cancel or refund

Refund Policy

Refunds are processed to the original payment method within 5-10 business days. Refund eligibility:

• Full refund if order cancelled by PAPER YARROW
• Partial or full refund for customer-initiated cancellations (at our discretion)
• No refunds for perishable goods after successful delivery or pickup
• Refunds for damaged or incorrect items (see section 9)

All refund decisions are final and at the sole discretion of PAPER YARROW.

9. Damaged or Incorrect Items

If you receive damaged, defective, or incorrect items, please contact us within 24 hours of delivery or pickup:

• Email us with your order number and photos of the issue
• We will review your claim and offer a replacement, store credit, or refund as appropriate

Claims submitted after 24 hours may not be eligible for resolution.

10. Promo Codes and Discounts

Promotional discount codes may be offered from time to time. Promo code terms:

• Promo codes must be entered during checkout before payment
• Each code has specific terms: expiration dates, usage limits, and minimum order requirements
• Only one promo code may be used per order
• Promo codes cannot be applied retroactively to completed orders
• We reserve the right to modify or cancel promo codes at any time
• Misuse of promo codes may result in order cancellation

11. Intellectual Property

All content on the PAPER YARROW website, including text, images, graphics, logos, and designs, is the property of PAPER YARROW or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.

12. Limitation of Liability

To the fullest extent permitted by law, PAPER YARROW and its owners, employees, and agents shall not be liable for:

• Delays or failures in delivery caused by third-party carriers, weather, traffic, or other events beyond our control
• Spoilage of perishable goods after successful delivery or pickup
• Damages resulting from customer error (incorrect address, failure to refrigerate, improper care)
• Indirect, incidental, or consequential damages arising from your order or use of our services

Maximum Liability: In no event shall our total liability exceed the amount you paid for your order.

13. Indemnification

You agree to indemnify, defend, and hold harmless PAPER YARROW and its owners, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

14. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in New York County, New York, or in the courts of New York County if arbitration is not applicable.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. The "Last Updated" date at the top of this page indicates when these Terms were last revised. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and PAPER YARROW regarding your use of our services and supersede all prior agreements and understandings.
